Terms and Conditions

The following Terms and Conditions represent a contract (the "Agreement") between you (hereinafter, the "User" or "Customer") and PixRace. This agreement governs the access, use, and engagement of services offered by PixRace through its digital platform for searching, viewing, and selling event photographs. PixRace reserves the right to modify these Terms and Conditions at any time. Modifications will be effective from the moment of their publication on the website, and it is the User's responsibility to review them periodically. None of the provisions of this instrument contravenes current Peruvian legislation. In the event that any clause is declared contrary to law, it will be deemed eliminated in full, while the remaining provisions remain in force. IMPORTANT: These Terms and Conditions are applicable only to services provided within the territory of the Republic of Peru.

1. The Company

PixRace is a legal entity duly constituted in accordance with the laws of the Republic of Peru, dedicated to providing digital services related to the management, search, commercialization, and distribution of event photographs through its technological platform, hereinafter the "Website" or the "Platform". PixRace is the owner and administrator of the corresponding website, as well as the technological infrastructure that enables the provision of the service.

2. Purpose

These Terms and Conditions govern all commercial, contractual, and usage relationships between PixRace and Users who access the Platform to: • Search for event photographs • View photographic content • Purchase, download, or license digital photographs The use of the Platform implies the express, informed, and voluntary acceptance of these Terms and Conditions.

3. Conditions of Use

The User agrees to use the Platform only for personal and lawful purposes, related to the search and acquisition of event photographs. The following is prohibited: • Downloading, copying, modifying, redistributing, or commercially exploiting content without authorization • Using the Platform for unlawful or fraudulent purposes • Violating intellectual property rights or image rights of third parties The content, software, design, and functionalities of the Website are the property of PixRace or third-party licensors and are protected by national and international copyright laws. Violation of these conditions may result in the suspension or cancellation of the User's account and corresponding legal actions.

4. Registration and User Account

To access certain functionalities, the User must create a personal account, providing truthful, current, and complete information. The account is personal and non-transferable. The User is responsible for the use of their credentials and for all activities carried out from their account. PixRace may suspend or cancel the account when it detects false information, misuse, or non-compliance with these Terms.

5. Use of Images and Photo Search

PixRace allows the User to upload photographs or capture images through the device camera for the sole purpose of facilitating the search and viewing of event photographs. These images: • Are used exclusively for the provision of the service • Are not commercialized or transferred to third parties • Are not used for purposes other than those described The User declares to have the necessary rights over the images uploaded to the Platform.

6. Photographic Content and Copyright

The photographs available on the Platform belong to photographers, organizers, or authorized third parties. The User acquires only a license to use the purchased photographs, according to the conditions indicated in each case, without this implying a transfer of copyright. Unauthorized reproduction, distribution, or commercial exploitation of the photographs is prohibited.

7. Purchase Conditions

Purchases made on PixRace correspond to digital content, so once the download has been made or access has been enabled, no refund applies, except as provided by law or due to an error attributable to the Platform. Prices include applicable service charges and will be informed to the User before confirming the purchase. The transaction will be subject to validation of the corresponding payment method. PixRace does not store credit or debit card data.

8. Availability, archiving, and restoration of purchased photographs

Purchased photographs will remain available in the User's PixRace account for one year from the exact date and time of purchase. During this period, the User may download them immediately when an active copy exists or request restoration when they are archived. Original files will remain immediately downloadable for the first 105 days after the photograph is uploaded. Once that period has elapsed, the original will be archived and will no longer be immediately downloadable. If a photograph is already more than 105 days old when purchased, checkout will disclose this condition and its preparation may take up to 12 hours. PixRace will notify the User by email when it is ready. Each restored copy will remain immediately downloadable for 7 days. Until one year has elapsed since purchase, the User may request up to a maximum of 3 restorations for each purchased photograph if the copy is archived again. The automatic restoration initiated when an already archived photograph is purchased counts toward this limit. A restoration requested close to the annual expiration will remain available only until the date and time when that year is completed. Once one year has elapsed since purchase or all 3 permitted restorations have been used, no additional restorations may be requested. At the end of the year, the photograph can no longer be downloaded or restored and the account will retain only the historical purchase information. This policy applies to both individual and grouped or ZIP downloads. The User is responsible for downloading and backing up photographs within the displayed periods.

9. Payments and Payment Methods

Payments may be made through: • Credit or debit cards • Bank transfers • Digital wallets or other enabled methods The conditions of each payment method are governed by the contracts entered into between the User and the corresponding financial entity.

10. Return Policy

Given the digital nature of the service, no returns are accepted once the content has been made available to the User, unless there is a technical failure attributable to PixRace.

11. Third-Party Content

The Website may contain links to third-party sites. PixRace is not responsible for the content, policies, or practices of such external sites.

12. Personal Data Protection

The processing of personal data is governed by PixRace's Privacy Policy, which forms an integral part of these Terms and Conditions and is aligned with Law No. 29733 – Personal Data Protection Law.

13. Use of Cookies

PixRace may use cookies and similar technologies to improve the User experience, analyze traffic, and personalize content. The User can manage these preferences from their browser.

14. Disclaimer

PixRace does not guarantee that the Platform is free from errors or interruptions. Nor is it responsible for damages arising from misuse of the Website or causes beyond its control.

15. Service Availability

PixRace does not guarantee the continuous availability of the service, although it will make reasonable efforts to maintain its operability.

16. Modifications

PixRace may modify these Terms and Conditions at any time. Continued use of the Website will imply acceptance of the modifications.

17. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Peru. Any dispute will be subject to the jurisdiction of the courts and tribunals of Lima.
